Please read all these terms and conditions

We endeavour to accept your order and in doing so make a legally enforceable agreement without further reference to you. You must read these Terms and Conditions to ensure that it contains what you want and nothing you are unhappy with.

Application

These Terms and Conditions will apply to the purchase of the goods by you (the Customer or you). We are Mood Seasons Ltd (the Supplier or us or we), whose trading name is Mood Seasons, a company registered under number 12623318 whose registered office is in the United Kingdom.
These are the terms on which we sell all Goods to you. By ordering any of the Goods or using the site, you agree to be bound by these Terms and Conditions. You can only purchase from the Website if you are eligible to enter a contract, are at least 18 years old and agree that you will not use the site for any illegal or unauthorised purpose.
Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of these Terms of Use, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Terms of Use to stay informed of updates. You will be subject to, will be deemed to have been made aware of and to have accepted, the changes in any revised Terms of Use by your continued use of the Site after the date such revised Terms of Use are posted.

Goods

The description of the Goods is as set out in the Website, Facebook and Instagram shops or other form of advertisement. Any description is for illustrative purpose only, to give you as best an idea as possible. There may be small discrepancies in the scent, size, colour of the Goods Supplied. However, when it comes to online sales of fragrances, there are a multitude of factors which affect a consumer’s preference, so we would not be held accountable for this.
In the case of any Goods made to your special requirements, for example selection of fragrances for a bundle, it is your responsibility to ensure that any information or specification you provide is accurate.
All Goods which appear on the Website are subject to availability.
We can make changes to the Goods which are necessary to comply with any applicable law or safety requirement. We will notify you of these changes.

Personal information

We retain and use all information strictly under the Privacy Policy.
We may contact you by using e-mail or other electronic communication methods, and by pre-paid post and you expressly agree to this.
According to Data Protection 1998 we do not supply any of your details to a third party, unless you have given Mood Seasons permission to do so.

Basis of Sale

The description of the Goods in our website does not constitute a contractual offer to sell the Goods. When an Order has been submitted on the Website or any of our other shops (Facebook, Shopify or Instagram), we can reject it for any reason, although we will try to tell you the reason without delay.
The order process is set out on the Website. Each step allows you to check and amend any errors before submitting the Order. It is your responsibility to check that you have used the ordering process correctly.
A Contract will be formed for the sale if Goods ordered only when you receive an email from us confirming the Order (Order Confirmation). You must ensure that the Order Confirmation is complete and accurate and inform us immediately of any errors. We are not responsible for any inaccuracies in the Order placed by you. By placing an Order, you agree to us giving you confirmation of the Contract by means of an email with all information in it (i.e. the order Confirmation). You will receive the Order Confirmation within a reasonable time after making the Contract, but in any event not later than the delivery of any Goods supplied under the Contract.
No variation of the Contract, whether about description of the Goods, Fees or otherwise, can be made after it has been entered into unless the variation is agreed by the Customer and the Supplier in writing.
Orders may be subject to extra security checks at our discretion. This may include confirmation of Credit/Debit card details and full address details. Mood Seasons reserves the right to cancel any orders if this information cannot be supplied.

Price and Payment

All Goods and Prices are subject to availability.
All prices are in UK Pounds sterling. The prices in other currencies are based on daily average exchange rates. As a result, the total charge may vary depending on the rate of exchange at that time.
The price of the Good and any additional delivery or other charges is set out on the Website at the date of the Order or such other price as we may agree in writing.
Please note special offer prices are only valid if the item is purchased at the offer price, whilst the offer is in place. Mood Seasons will not offer a refund for items bought at a higher price when it is not on special offer.
Prices and charges include VAT at the rate applicable at the time of the Order.
You must pay by PayPal or by submitting your credit or debit card details with your Order and we can take payment immediately.

Delivery

We will endeavour to deliver the Goods to the Delivery Location by the time and within the agreed period or, failing any agreement, without undue delay and, in any event, not more than 30 days after the day on which the Order was despatched.
Mood Seasons does not know the worldwide taxes, duties and implications for postage to every country. Therefore, the customer is responsible for checking what taxes are in their country, and for payment of any fees or customs charges to bring the product into their country. We will not pay them. If these are not paid and the products are returned to Us, the recipient will be held accountable for any losses incurred or charges made to us for this return.
You agree we may deliver Goods in instalments if we suffer a shortage of stock or other genuine and fair reason, subject to the above provisions and provided you are not liable for extra charges.
If Mood Seasons has insufficient stock to deliver the goods ordered by you, we will notify you as soon as possible to either offer an alternative item (to the same value) or we will refund the cost of the unavailable goods. Mood Seasons will not be obliged to offer any additional compensation for disappointment suffered.
If you or your nominee fail, through no fault of ours, to take delivery of the Goods at the Delivery Location, we may Charge the reasonable cost of storing and redelivering them.
The Goods will become your responsibility from the completion of delivery or Customer collection. You must, if reasonably practicable, examine the Goods before accepting them.

Returns

Customers have the right to request to return their order within 7 working days of receiving their goods. This can be done by completing the form on our contact us page and quoting your order number. Where the customer exercises their right to cancel an order, the product costs only will be refunded within 30 days of receipt of returned goods as we do not refund postal charges.
All returned products will be refunded or exchanged provided they have not been used, postage costs will only be refunded if goods received were incorrect, faulty or damaged upon receipt, photographic evidence may be required to support a claim.
Returned items should be sent by Recorded Delivery, Mood Seasons will not cover return postage costs for Special Delivery or any courier service.
Any returned items must be received within 30 days of purchase to qualify for a refund or replacement. Any returned faulty goods after this time may only receive a part refund depending on the amount of product used. Any goods returned more than 2 months after purchase, whether faulty or not, will not be refunded or replaced and the returned goods will be disposed of.
If the rare occasion occurs whereby the customer receives an incorrect item, Mood Seasons will, upon receipt of the returned incorrect item, send the correct item and refund the return postage. If the customer requires a fast replacement, Mood Seasons will recharge the customer, send the correct item and on receipt of the returned incorrect item, refund the customer for the cost of their 2nd order and for their return postage.
Orders returned ‘Not Called For’ by Royal Mail be refunded the cost of products upon receipt, not including postage. Customers will be notified, and the order will be cancelled.
None of the above affects your statutory rights.

Intellectual Property Rights

Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us or free to use by us.
Provided that you are eligible to use the Site, you are granted a limited license to access and use the Site and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use. Gaining access may be implied through buttons inviting you to share content on social media. We reserve all rights not expressly granted to you in and to the Site, the Content and the Marks.

Prohibited activities & Terms of Termination

You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavours except those that are specifically endorsed or approved by us.
These Terms of Use shall remain in full force and effect while you use the Site. WITHOUT LIMITING ANY OTHER PROVISION OF THESE TERMS OF USE, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE SITE (INCLUDING BLOCKING CERTAIN IP ADDRESSES), TO ANY PERSON FOR ANY REASON OR FOR NO REASON, INCLUDING WITHOUT LIMITATION FOR BREACH OF ANY REPRESENTATION, WARRANTY, OR COVENANT CONTAINED IN THESE TERMS OF USE OR OF ANY APPLICABLE LAW OR REGULATION. WE MAY TERMINATE YOUR USE OR PARTICIPATION IN THE SITE OR DELETE ANY CONTENT OR INFORMATION THAT YOU POSTED AT ANY TIME, WITHOUT WARNING, IN OUR SOLE DISCRETION.
If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party. In addition to terminating or suspending your account, we reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.

User generated Contributions

The Site does not offer users to submit or post content. We may provide you with the opportunity to create, submit, post, display, transmit, perform, publish, distribute, or broadcast content and materials to us or on the Site, including but not limited to text, writings, video, audio, photographs, graphics, comments, suggestions, or personal information or other material (collectively, "Contributions"). Contributions may be viewable by other users of the Site and through third-party websites. As such, any Contributions you transmit may be treated in accordance with the Site Privacy Policy. When you create or make available any Contributions, you thereby represent and warrant that:

The creation, distribution, transmission, public display, or performance, and the accessing, downloading, or copying of your Contributions do not and will not infringe the proprietary rights, including but not limited to the copyright, patent, trademark, trade secret, or moral rights of any third party.
You are the creator and owner of or have the necessary licenses, rights, consents, releases, and permissions to use and to authorize us, the Site, and other users of the Site to use your Contributions in any manner contemplated by the Site and these Terms of Use.
You have the written consent, release, and/or permission of each and every identifiable individual person in your Contributions to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of your Contributions in any manner contemplated by the Site and these Terms of Use.
Your Contributions are not false, inaccurate, or misleading.
Your Contributions are not unsolicited or unauthorized advertising, promotional materials, pyramid schemes, chain letters, spam, mass mailings, or other forms of solicitation.
Your Contributions are not obscene, lewd, lascivious, filthy, violent, harassing, libellous, slanderous, or otherwise objectionable (as determined by us).
Your Contributions do not ridicule, mock, disparage, intimidate, or abuse anyone.
Your Contributions do not advocate the violent overthrow of any government or incite, encourage, or threaten physical harm against another.
Your Contributions do not violate any applicable law, regulation, or rule.
Your Contributions do not violate the privacy or publicity rights of any third party.
Your Contributions do not contain any material that solicits personal information from anyone under the age of 18 or exploits people under the age of 18 in a sexual or violent manner.
Your Contributions do not violate any applicable law concerning child pornography, or otherwise intended to protect the health or well-being of minors;
Your Contributions do not include any offensive comments that are connected to race, national origin, gender, sexual preference, or physical handicap.
Your Contributions do not otherwise violate, or link to material that violates, any provision of these Terms of Use, or any applicable law or regulation.
Any use of the Site in violation of the foregoing violates these Terms of Use and may result in, among other things, termination or suspension of your rights to use the Site.

Contribution License

You and the Site agree that we may access, store, process, and use any information and personal data that you provide following the terms of the Privacy Policy and your choices (including settings).
By submitting suggestions or other feedback regarding the Site, you agree that we can use and share such feedback for any purpose without compensation to you.
We do not assert any ownership over your Contributions. You retain full ownership of all your Contributions and any intellectual property rights, or other proprietary rights associated with your Contributions. We are not liable for any statements or representations in your Contributions provided by you in any area on the Site. You are solely responsible for your Contributions to the Site and you expressly agree to exonerate us from all responsibility and to refrain from any legal action against us regarding your Contributions.

Submissions

You acknowledge and agree that any questions, comments, suggestions, ideas, feedback, or other information regarding the Site ("Submissions") provided by you to us are non-confidential and shall become our sole property. We shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these Submissions for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you. You hereby waive all moral rights to any such Submissions, and you hereby warrant that any such Submissions are original with you or that you have the right to submit such Submissions. You agree there shall be no recourse against us for any alleged or actual infringement or misappropriation of any proprietary right in your Submissions.
All complaints will be acknowledged within 7 working days, although we try to acknowledge all complaints immediately. The customer will be informed of all progress.

Site Management

We reserve the right, but not the obligation, to: (1) monitor the Site for violations of these Terms of Use; (2) take appropriate legal action against anyone who, in our sole discretion, violates the law or these Terms of Use, including without limitation, reporting such user to law enforcement authorities; (3) in our sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of your Contributions or any portion thereof; (4) in our sole discretion and without limitation, notice, or liability, to remove from the Site or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems; and (5) otherwise manage the Site in a manner designed to protect our rights and property and to facilitate the proper functioning of the Site.
We reserve the right to change, modify, or remove the contents of the Site at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our Site. We also reserve the right to modify or discontinue all or part of the Site without notice at any time. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Site.
We cannot guarantee the Site will always be available. We may experience hardware, software, or other problems or need to perform maintenance related to the Site, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the Site at any time or for any reason without notice to you. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Site during any downtime or discontinuance of the Site. Nothing in these Terms of Use will be construed to obligate us to maintain and support the Site or to supply any corrections, updates, or releases in connection therewith.
There may be information on the Site that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Site at any time, without prior notice.
